RULES OF PROCEDURE FOR TRAINEES
Article 1: Preamble
ENSOPCO is a registered independent training organization. Its commercial name is TEALE.
ENSOPCO is hereinafter referred to as the “training organization”.
The purpose of these Internal Regulations is to specify certain provisions applying to all registrants and participants in the various courses organized by ENSOPCO in order to allow the regular functioning of the courses offered.
Article 2: General provisions
In accordance with Article L6352-3 of the Labor Code, the purpose of these internal regulations is to define the general and permanent rules and to specify the regulations on health and safety as well as the rules relating to discipline, in particular the sanctions applicable to trainees and their rights in the event of a sanction.
Article 3: Scope
Persons concerned: This Regulation applies to all trainees enrolled in a session provided by ENSOPCO for the entire duration of the training followed. Each trainee is considered to have accepted the terms of this regulation when attending training provided by ENSOPCO and accepts that measures will be taken in the event of non-compliance with it.”
Location of the training: The training takes place either on the premises of ENSOPCO or (most often) in external premises. The provisions of this Regulation are applicable not only within the premises of ENSOPCO but also in any premises intended to receive training.
Article 4: Health and safety
Each trainee must, in addition, ensure that they respect the rules concerning their personal safety and that of other persons in force in the establishment where the training courses are provided by ENSOPCO.
When training takes place in a company or an establishment that already has internal regulations, the safety and health measures applicable to trainees are those of the latter regulation, in application of article L6352-3 of the Labor Code.
The health safety instructions in force are applied according to government recommendations.
Article 5: Alcohol and others
In application of Decree No. 2006-1386 of 15 November 2006 establishing the conditions for the application of the ban on smoking in places allocated to collective use, it is forbidden to smoke in training rooms, except in areas reserved for this use.
It is forbidden for trainees to bring alcoholic drinks to the training sites. It is also forbidden to enter the course premises while drunk.
It is also forbidden for interns, without special authorization, to eat their meals in the rooms where the courses are organized.
Article 6: Fire instructions
In accordance with articles R. 4227-37 and following of the Labor Code, fire instructions and in particular a map for the location of fire extinguishers and emergency exits are posted in the training rooms so as to be known to all trainees.
Article 7: Accident
Any accident or incident occurring during or during training must be immediately reported by the injured trainee or the persons witnessing the accident, to the head of the organization.
In accordance with article R6342-1 of the Labour Code, the accident occurring to the trainee while at the training site or while going to or returning from the training site is the subject of a declaration by the head of the organization to the social security fund.
Article 8: Dress and Behaviour
Trainees are invited to come to the training site in decent clothing and to behave correctly towards anyone present in the organization.
Article 9: Internship hours
The internship schedules are fixed by ENSOPCO or the “ordering” company and brought to the attention of the trainees either by the invitation sent by electronic means or when the training program is delivered. Interns are required to respect these schedules. ENSOPCO reserves, within the limits imposed by provisions in force, the right to modify internship schedules according to service requirements. Interns are required to respect these schedules. In case of absence or delay at the internship, it is preferable for the trainee to notify either the trainer, or the manager of the training organization, or the “client”.
Trainees are required to sign an attendance sheet every day for the duration of the training.
Article 10: Access to the training site
Unless expressly authorized by ENSOPCO, trainees who have access to the training site to follow their training cannot facilitate the introduction of third parties into the organization.
Article 11: Use of equipment
Each trainee has the obligation to keep in good condition the equipment given to him for his training and to use it in accordance with its purpose. The use of the material for other purposes, in particular personal purposes, is prohibited, except for the material made available for this purpose. At the end of the internship, the trainee is required to return all materials and documents in their possession belonging to the training organization, except the educational documents distributed during the training course.
It is strictly forbidden, unless expressly authorized, to record or film training sessions.
The educational documents provided during the training courses are protected by copyright. Their reproduction, without the authorization of the training organization, is strictly prohibited. These documents can only be reused for personal purposes.
Article 12: Responsibility of the training organization
ENSOPCO declines all responsibility in the event of loss, theft or deterioration of personal items of any kind brought by trainees to the training site.
Article 13: Respect for the confidentiality of trainee data
Any person employed by the training organization undertakes to keep confidential all personal and professional information of trainees that would be brought to their attention.
Article 14: Penalties
Any breach by the trainee of any of the provisions of these rules of procedure may be subject to a penalty.
Under Article R. 922-3 of the Labor Code, any measure, other than verbal observations, taken by the director of the training organization or his representative, following an action by the trainee considered by him to be at fault, whether this measure is likely to affect immediately or not the presence of the person concerned in the internship or to call into question the continuity of the training he receives, constitutes a sanction, within the meaning of article R. 922-3 of the Labor Code, any measure, other than verbal observations, taken by the director of the training organization or his representative.
Fines or other pecuniary sanctions are prohibited.
Depending on the seriousness of the wrongdoing, the penalty may consist of either a warning, a reprimand, or a definitive exclusion measure.
The director of the organization must inform of the sanction taken:
- The employer, when the trainee is an employee benefiting from a training program as part of a company's training plan;
- The employer and the joint organization that covered the training expenses, when the trainee is an employee benefiting from a training action as part of a training leave;
- The organization that financed the training action from which the trainee received.
Article 15: Disciplinary procedure
No sanctions may be imposed on the trainee without the trainee having been informed in advance of the grievances brought against him.
When the head of the training organization or his representative intends to impose a sanction that has an impact, immediate or not, on the presence of a trainee in a training course, the following procedure is carried out:
- The head of the training organization or his representative summons the trainee by indicating the purpose of this summons. This specifies the date, time and location of the interview. It is written and sent by registered letter or delivered to the interested party against discharge.
- During the interview, the intern can be assisted by a person of his choice (trainee or employee of the training organization). The summons mentioned above mentions this option.
- The head of the training organization or his representative indicates the reason for the planned sanction and collects the explanations of the trainee.
- In the event that a permanent exclusion from training is envisaged and there is a development council, a disciplinary committee is set up, which includes representatives of the trainees. It is referred by the head of the training organization or his representative after the above interview and formulates an opinion on the exclusion measure envisaged. The intern is notified of this referral. At his request, he is heard by the Disciplinary Committee. He may be assisted by a person of his choice, a trainee or an employee of the training organization within one clear day after his meeting.
- The sanction may not take place less than one clear day, nor more than fifteen days after the interview, or where applicable, after the transmission of the opinion of the disciplinary committee. It is the subject of a written and reasoned decision, notified to the trainee in the form of a letter given to him against discharge or a registered letter. When the act has given rise to a temporary precautionary measure of exclusion with immediate effect, no final sanction relating to this action may be taken without the trainee having been informed in advance of the grievances brought against him and possibly the procedure described above having been respected.
Article 16: Various provisions
At the end of each training, the trainee is given a report of the training that he must complete and given to the trainer. An end-of-internship certificate will then be issued to the interns.
Article 17: Entry into force
A copy of these rules is included in the training materials provided to participants.
This regulation comes into force as of 01/03/2022.
